‘Credible Threat’ at Edenvale Hospital: Police Commander Explains Why Cat Matlala Co-Accused Was Removed

‎A new state witness has told the High Court in Johannesburg that police had received information pointing to a credible threat of possible violence at Edenvale Hospital following the admission of accused number one, Musa Kekana, in 2024.

‎

‎Former Bramley police station commander Owen King was testifying in a trial-within-a-trial, as Kekana challenges the admissibility of evidence obtained by police during his arrest in connection with the alleged murder of Armand Swart.

‎

‎Kekana has accused police of acting unlawfully and “rogue” during the operation that led to his arrest.

‎

‎King told the court that, based on the information available to him at the time, he believed there was a potential risk of violence at the hospital and that steps had to be taken to prevent the situation from escalating.

‎

‎He said his concern was not limited to the detainee, but also extended to hospital staff, police officers and members of the public who could potentially be caught up in violence.

‎

‎“My concern was that possibly her staff, or my staff or people at the hospital could be injured … my request was that the detainee be discharged,” King told the court.

‎

‎The former station commander said his decision was informed by the information he had received regarding the potential threat.

‎

‎The testimony forms part of Kekana's legal challenge over evidence the State intends to rely on against him.

‎

‎Kekana is standing trial alongside businessman Vusimuzi “Cat” Matlala and three other accused. The group faces charges relating to alleged conspiracies and attempts to kill Matlala's former partner, Tebogo Thobejane, businessman Joe “Ferrari” Sibanyoni and music producer Seunkie Mokubung.

‎

‎The latest testimony places renewed focus on the circumstances surrounding Kekana's arrest and the police decisions taken while he was receiving medical attention at Edenvale Hospital.

‎

‎The trial-within-a-trial will determine whether the disputed evidence was lawfully obtained and whether it can ultimately be admitted as part of the State's case.

‎

‎Matlala and his co-accused remain before the High Court in Johannesburg as proceedings continue.
