Mkhwanazi Defence Pushes for Bail, Says State Has No Proof He Will Interfere With Witnesses

‎The defence of suspended Ekurhuleni Metropolitan Police Department (EMPD) Deputy Chief Julius Mkhwanazi has urged the court to grant him bail, arguing that the State has failed to demonstrate a concrete risk that he would interfere with witnesses or obstruct the course of justice.
‎
‎During closing arguments in Mkhwanazi’s bail application, his lawyer, Advocate Peter Wilkins, maintained that his client is not a flight risk and has previously demonstrated that he can comply with strict bail conditions and court orders.
‎
‎Wilkins also argued that there is no evidence before the court showing that Mkhwanazi poses a danger to the public or to any specific individual.
‎
‎Mkhwanazi is facing charges linked to the 2022 murder of businessman Emmanuel Mbense, with the State opposing his release on bail.
‎
‎The defence submitted that any concerns raised by the State could be addressed through enforceable conditions rather than continued detention.
‎
‎Wilkins pointed to Mkhwanazi’s previous compliance with stringent conditions, including surrendering his passport, residing at a disclosed address, attending all court appearances and refraining from contacting identified State witnesses about the merits of the case.
‎
‎The proposed restrictions also included preventing Mkhwanazi from accessing relevant EMPD or SAPS records and from attending operational EMPD premises, except where lawfully required.
‎
‎According to the defence, these conditions would sufficiently address the State’s concerns, particularly because those concerns were described as largely inferential.
