‎President Ramaphosa Signs New Public Service Commission Act Into Law

‎

‎President Cyril Ramaphosa has signed the Public Service Commission Bill into law, strengthening the role and independence of the Public Service Commission (PSC) in promoting constitutional values, professional ethics and effective public administration.

‎

‎The new Public Service Commission Act repeals the 1997 legislation and expands the Commission’s mandate to include monitoring and evaluation of practices in the Public Service, as well as investigations into administrative practices and service-delivery failures.

‎

‎The PSC is an independent constitutional institution established under Section 196 of the Constitution. It is required to act impartially and without fear, favour or prejudice while promoting efficient public administration and high standards of professional ethics.

‎

‎The new law also extends the Commission’s oversight mandate to local government and public entities. It regulates the appointment of Commissioners by the President and provides for a Secretariat to support the Commission’s work.

‎

‎Under the Act, the Commission can require relevant executive authorities or other persons against whom it makes a decision to report on progress in implementing those decisions.

‎

‎Anyone found guilty of obstructing the Commission in carrying out its powers and functions could face up to 12 months in prison, a fine of up to R50,000, or both.

‎

‎President Ramaphosa said the legislation should be welcomed by public servants and citizens as a measure aimed at improving public services and supporting growth through ethical and efficient conduct.

‎

‎He also called on public servants to uphold the Batho Pele (People First) principles, saying the enactment of the law during Public Service Month should encourage renewed pride and ethical conduct across the Public Service.
